OWNERSHIP 1.1 SchoolCAD, including its source code and object code (minified or not), software design, structure, sequence and organisation, user interface, documentation, help pages, lessons, tutorials, presets, templates, audio recordings, translations, artwork, logos and other materials (together, the "Software"), is owned by Sine Surf Pty Ltd ("we", "us"), except for the third-party components described in clause 6. 1.2 The Software is protected by the Copyright Act 1968 (Cth) and, through the Berne Convention for the Protection of Literary and Artistic Works, the WIPO Copyright Treaty and the TRIPS Agreement, by copyright law in every country that is a party to those treaties. 1.3 The Software and its source code are confidential. Their publication to web browsers, so that the SchoolCAD app can run, does not make them public domain, open source or free to reuse. 2. NO LICENCE IS GRANTED 2.1 No licence or other right in the Software is granted to anyone, by implication, estoppel or otherwise, except as set out in clause 3 or in a written agreement signed by us. 3. THE ONLY PERMITTED USE 3.1 You may use the SchoolCAD app at schoolcad.app (and at addresses we provide to schools) through a web browser, as an end user, for designing and learning, in accordance with our Terms of Use. That use includes the temporary copies a browser makes to run the app. The Terms of Use are at https://schoolcad.com/terms. 3.2 Designs, drawings and files that you make with SchoolCAD are yours. This licence does not claim them. 4. WHAT YOU MUST NOT DO Except to the extent clause 5 applies, you must not, and must not help, allow or instruct anyone else (including any software agent or artificial intelligence system) to: 4.1 copy, reproduce, save, download, mirror, cache for reuse, or host the Software or any part of it; 4.2 modify, adapt, translate, or create derivative works from the Software or any part of it; 4.3 distribute, publish, sell, rent, lend, sublicense, transmit or make the Software available to anyone, or frame or embed it in another website or application; 4.4 decompile, disassemble, de-minify, de-obfuscate, reformat, rename, annotate or otherwise reverse engineer the Software, or attempt to derive its source code, design or algorithms, whether by hand or with automated tools, including artificial intelligence models; 4.5 use the Software, or anything derived from it, to train, fine-tune, evaluate or prompt any machine learning or artificial intelligence model, or to generate code, content or designs that reproduce or imitate it; 4.6 scrape, crawl or harvest the Software or its content, other than ordinary search-engine indexing of public pages; 4.7 use the Software, or knowledge gained by examining its code, to design, build, market or improve a product or service that competes with SchoolCAD; 4.8 remove, alter or obscure any copyright notice, licence notice, trade mark or attribution in or on the Software; 4.9 bypass, disable or interfere with any sign-in, password, access control, rate limit or other security measure; or 4.10 use the Software in any way that infringes our rights or breaks any law. 5. RIGHTS THE LAW GIVES YOU 5.1 Nothing in this licence excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including: (a) the exceptions in sections 47B to 47F of the Copyright Act 1968 (Cth), which section 47H preserves; and (b) any guarantee, right or remedy under the Australian Consumer Law or other consumer protection law that applies to you. 5.2 Where clause 5.1 applies, this licence limits your conduct only to the greatest extent the law permits, and you must use any statutory exception strictly for its purpose. For example, the interoperability exception does not permit using our code to build a competing product. 6. THIRD-PARTY COMPONENTS 6.1 The files in public/vendor/ and any other component identified as third-party software (including OpenCascade Technology, replicad, three.js, Kiri:Moto and their dependencies) are licensed by their owners under the licences supplied with them, not under this licence. 6.2 Nothing in this licence restricts any right those licences give you. In particular, for OpenCascade Technology, which is licensed under the GNU Lesser General Public License version 2.1, you may modify the combined work for your own use and reverse engineer it for debugging such modifications, to the extent section 6 of that licence requires. Requests for the corresponding source of those components can be sent to the address below. 7. TRADE MARKS 7.1 SchoolCAD™, the SchoolCAD logo and related names and marks are trade marks of Sine Surf Pty Ltd. No right to use them is granted. 8. ENFORCEMENT 8.1 Any permission we give in writing ends automatically and immediately if its terms or this licence are breached. 8.2 We actively protect the Software. Unauthorised use may result, without further notice, in proceedings for injunctions, damages or an account of profits, additional damages for flagrant infringement under section 115(4) of the Copyright Act 1968 (Cth), delivery up or destruction of infringing copies, and legal costs; in takedown notices to hosting providers, code repositories, app stores and search engines in any country (including under the United States Digital Millennium Copyright Act); and, for infringement on a commercial scale, in referral to authorities, as it may be a criminal offence. 8.3 Our delay or failure in enforcing any part of this licence is not a waiver of it. 9. GOVERNING LAW 9.1 This licence is governed by the laws of New South Wales, Australia. The courts of New South Wales and the Federal Court of Australia have non-exclusive jurisdiction, and we may also seek urgent or injunctive relief in any court anywhere. 9.2 If any part of this licence is invalid or unenforceable, it is read down to the extent necessary, or severed, and the rest continues in full effect. 10.
